CHAPTER 111: SOLICITORS AND TRANSIENT VENDORS

111.01 PROHIBITED ACTIVITIES.

 (A) It is hereby declared to be in the public interest and for the public welfare, in order to protect the public from fraud and imposition and prevent loss from fraudulent or unscrupulous high pressure sales tactics.

2. (1) The unrequested visitation by solicitors, hawkers, peddlers, itinerant merchants and transient vendors of merchandise at private residences for the purpose of soliciting orders or selling merchandise without the prior specific request and authorization from the owner or occupant thereof is prohibited. The violation thereof shall be punishable as a public nuisance.

(2) The penalty for violation shall be an order of abatement and a fine of not more than $100 and costs of prosecution.

3. This prohibition is not intended to embrace the gratuitous dissemination of circulars or handbills with respect to noncommercial matters, such as a political rally, a church supper or a town meeting, unless the same occurs in the nighttime, which nighttime solicitation is declared to be unlawful and a violation of this section. Nighttime solicitation is solicitation anytime after sundown and before sunrise; provided that for a first offense, the police shall only issue a warning, but for the next and all subsequent offenses, the same is declared to be a nuisance and shall be punishable as a violation of tiis section.
4. A NUISANCE as used in this section is defined as the practice of solicitors, peddlers, hawkers and itinerant merchants of calling on private residences uninvited for the purpose of soliciting orders and selling merchandise which work as a hurt, inconvenience or damage and disturbs the owner or possessor of the property in his or her peaceful enjoyment of his or her property.

111.99 PENALTY.

1. 1. Any person, or any person's agent or servant, who violates any of the provisions of this chapter, unless otherwise specifically provided herein, shall be deemed guilty of an offense and upon conviction thereof shall be fined in any sum not exceeding $500. A new violation shall be deemed to have been committed every 24 hours of failure to comply with the provisions of this chapter.
   2. (1) Whenever a nuisance exists as defined in 111.01, the municipality may proceed by a suit in equity to enjoin, abate and remove the same in the manner provided by law.

(2) Whenever, in any action, it is established that a nuisance exists, the Court may, together with the fine or penalty imposed, enter an order of abatement as a part of the judgment in the case. (1999 code, 10-501) (Ord. 00-20, passed 6-6-2000)

AN ORDNANCE TO AMEND CHAPTER 97: FIRE REGULATIONS OF THE MUNICIPAL

CODE OF THE CITY OF FRIEND, NEBRASKA TO REGULATE OUTDOOR FIREPLACES,

TO REPEAL ALL ORDINANCES IN CONFLICT HEREWITH, TO PROVIDE FOR THE POSTING OR PUBLICATION OF THIS ORDINANCE IN PAMPHLET FORM; AND TO PROVIDE FOR A TIME WHEN THIS ORDINANCE SHALL TAKE EFFECT.

Section 1. Chapter 97 of the Municipal Code of the City of Friend, Nebraska is amended as follows:

97.024 DEFINITIONS

For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different mean-mg.

CHIMINEA. An outdoor patio fireplace, usually made from clay, intended to confine and control outdoor wood fires.

FIRE PIT. An above-ground or below-ground vessel usually constructed of steel, concrete, brick and/or stones with a heavy steel screen cover in which a contained fire is made.

FIRE RING. A device used to contain recreational fires and prevent them from spreading. Commonly constructed using a metal tube partially buried in the ground, poured concrete, stones, or other type of material used for an enclosure.

OUTDOOR FIREPLACE. An area that uses wood as a fuel and is used for contained recreational fires for the purpose of outdoor cooking and personal enjoyment. includes fire pits, portable fire pits, chimineas, and fire rings. Does not include barbeque grills that use propane or charcoal as a fuel and are primarily for outdoor cooking.

PORTABLE FIRE PIT. A freestanding vessel usually constructed of steel, concrete, brick and/or stones and constructed above ground with a heavy steel screen cover intended to confine and control outdoor wood fires.

FIRE PREVENTION

97.029 OUTDOOR FIREPLACE REGULATION.

(A) All outdoor fireplaces shall meet the following requirements:

(l) A minimum ten-foot clearance shall be maintained between the outdoor fireplace and combustible walls, roofs, fences, and other combustible material. A minimum ten-foot clearance shall also be maintained between the outdoor fireplace and combustible balconies or decks unless the outdoor fireplace is placed on a stable, non-combustible surface such as a concrete pad.

 

2. Outdoor fireplaces shall be constructed of concrete or approved non-combustible materials. The fire fuel area and openings shall be completely enclosed by steel screening or an approved non-combustible screening material with openings in screening to be not larger than one-half-inch square. Vent stacks and chimneys shall have a steel screen cover made of heavy wire mesh or other non-combustible material with openings not larger than one-half-inch square or as approved by the building inspector. Fire fuel areas for fire pits shall be covered with a steel screen cover made of heavy wire mesh or other non-combustible material with openings not larger than one-half-inch square. Not permitted are barrels, half-barrels, drums or similarly constructed devices.
3. The fuel area for a fire pit shall not be larger than three feet in diameter and a height of more than two (2) feet.
4. Outdoor fireplaces shall be placed on a stable non-combustible surface such as a

concrete pad. Outdoor fireplaces shall not be located on combustible balconies or decks (unless they are located on a stable, non-combustible surface such as a concrete pad), or on any balcony above the first floor. Outdoor fireplaces shall not be located under any combustible balcony or any overhanging part of a structure.

5. Outdoor fireplaces shall only burn untreated wood. Petroleum products, rubbish, grass, leaves, cardboard, plastics, rubber of any material that may flow out of the containment or cause excessive heat, smoke, or offensive smell shall not be permitted.
6. The amount of material being burnt shall be limited to ensure the flames are confined inside the fuel area of the outdoor fireplace and the flames do not extend into the chimney or above the pit. The manufacturer's recommendation on the maximum amount of fuel to be used at one time shall be followed.
7. Outdoor fireplaces shall be under constant supervision by at least one (1) responsible person of age eighteen (18) or older from the ignition of the fire until the fire is completely extinguished, and embers are cool and the fire will not rekindle.
8. A garden hose connected to a water supply or other approved fire extinguishing equipment shall be readily available for use.

9. Outdoor fireplaces shall not be operated when winds are blowing over twenty (20) mph and wind direction will cause smoke, embers, or other burning materials to be carried by the wind toward any building or other combustible materials. Outdoor fireplaces shall not be operated when weather conditions are extremely dry.
10. The owner is responsible to ensure proper maintenance and care is accomplished in accordance with manufacturer's instructions. The outdoor fireplace shall be checked regularly for the appearance of cracks and other physical deterioration or loose parts.
11. Smoke from any outdoor fireplace shall not create a nuisance for neighboring property owners. The fire shall be extinguished immediately upon the complaint of the neighboring property owner of any smoke nuisance. The fire chief is authorized to require outdoor fireplace use to be immediately discontinued if the use of the outdoor fireplace is determined by the chief to constitute a hazardous condition to occupants of surrounding property.
12. A site plan showing the location of the outdoor fireplace on the property and a detailed drawing of the construction of the outdoor fireplace, along with a permit fee of $10.00, shall be submitted to the Municipal Clerk who will forward plans and drawings to the building inspector for review. Approved plans will serve as the permit. A permit will not be required for portable fire pits of chimineas provided they are commercially designed and have been approved by an independent testing laboratory. Outdoor fireplaces shall comply with the city zoning and building ordinances.

Section 2. All ordinances or parts of ordinances passed and approved prior to the passage of this ordinance and which are in conflict with the provisions of this ordinance are hereby repealed.

Section 3. This ordinance shall be in full force and effect and after its passage, approval and either posting or publication in pamphlet form as provided by law.

FIREWORKS

97.075 DEFINED.

FIREWORKS shall mean any composition or device designed for the purpose of producing a visible or audible effect by combustion, deflagration or detonation and which meets the definition of common or special fireworks set forth by the United States Department of Transportation in C.F.R. 97.076 PERMITTED FIREWORKS.

1. It shall be unlawful for any person to ignite or cause to be exploded fireworks or firecrackers of any description whatsoever, except sparklers, vesuvious fountains, spray fountains, torches, color fire cones, star and comet type color aerial shells without explosive charges for the purpose of making a noise, color wheels, lady fingers, not exceeding seven-eighths inch in length or one-eighth inch in diameter, and which do not contain more than 50 milligrams each in weight of explosive material.
2. The provisions of this section shall not apply to any fireworks to be used for purpose of public exhibitions or display under authorization of the governing body or to fireworks furnished for agricultural purposes pursuant to written authorization from the State Fire Marshal. 97.077 SALE AND USE.

It shall be unlawful for any person to sell, hold for sale or offer for sale as distributor, jobber or retailer any fireworks without first obtaining a license from the State Fire Marshal. Licensees shall only sell fireworks which have been approved by the State Fire Marshal and permissible fireworks may be sold at retail only between December 28 and January 1 , and between June 24 and July 5 of each year. During these dates, it shall be unlawful to discharge, explode or use permissible fireworks on any Monday through Thursday prior to 10:00 a.m. and after 11:00 p.m., and on any Friday, Saturday, Sunday or July 4 prior to 10:00 a.m. and after midnight.

97.078 PROHIBITED USES.

1. It shall be unlawful for any person to discharge, explode, fire, launch or throw any fireworks or any object which explodes upon contact with another object:
   1. From or into any motor vehicle;
   2. At or near any person;
   3. Into or upon any building;
   4. Onto or at any group of persons; or
   5. Into or upon the premises of another person.
2. For purposes of this section, PERSON shall mean any natural person or any private or public firm, partnership or corporation. It shall further be unlawful for any person to discharge, fire, launch or throw any fireworks from, to or on any private property without the expressed permission of the owner of the property. The provisions of this section shall not apply to any fireworks to be used for the purpose of public exhibitions or displays under authorization of the governing body. 71.08 GOLF CARTS; OPERATION AND USE; HOURS AND REQUIREMENTS.

The operation of golf carts upon the public streets and rights-of-way within the city limits is authorized only in those areas which are zoned as residential areas. Golf carts shall be operated only between the hours of sunrise to sunset. Golf cart operation shall further be allowed only by use of the most direct route between the Friend Country Club and the place of permanent storage of the golf cart, and no operation for any other purpose of transportation shall be allowed. The operator of the golf cart shall be at least 16 years of age and hold a driver's license valid within the state, or be at least 14 years of age; provided that the operator of that age shall be accompanied in the golf cart by a person of at least 21 years of age who holds a driver's license valid within the state. Any golf cart operating outside the permitted hours of sunrise to sunset shall be equipped with head lights and tail lights in compliance with Neb. RS 60-6,219. All golf carts operated as above permitted shall at all times be subject to the Nebraska Rules of the Road which are applicable to the operation and use of motor vehicles.
