04/03/2013 Special Meeting
A meeting of the Mayor and City Council of the City of Friend, Nebraska, was held at the Friend City Hall in said City on the 3rd of April, 2013, at 5:30 o'clock P.M. Present were: Mayor: James Vossler; Council Members: Phyllis Ryan, Harlan Schrock, Stanley Krause, Absent: Dan Drake. Notice of the meeting was given in advance thereof by publication, a designated method for giving notice, as shown by the (Affidavit of Publication) (Certificate of Posting Notice) attached to these minutes. Notice of this meeting was given to the Mayor and all members of the Council and a copy of their acknowledgment of receipt of notice and the agenda is attached to the minutes. Availability of the agenda was communicated in the advance notice and in the notice to the Mayor and Council of this meeting. All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public. The Mayor publicly stated to all in attendance that a current copy of the Nebraska Open Meetings Act was available for review and indicated the location of such copy posted in the room where the meeting was being held.
Council Member Harlan Schrock introduced Ordinance No. 12-727-A entitled:
AN ORDINANCE CREATING STREET IMPROVEMENT DISTRICTS NO. 2013-1 TO 2013-6 INCLUSIVE IN THE CITY OF FRIEND, NEBRASKA, ORDERING THE CONSTRUCTION OF STREET IMPROVEMENTS THEREIN AND ORDERING THE PUBLICATION OF THE ORDINANCE IN PAMPHLET FORM
and moved the statutory rule requiring reading on three different days be suspended. Council Member Ryan seconded the motion to suspend the rules and upon roll call vote on the motion the following Council Members voted YEA: Krause, Ryan, Schrock. The following voted NAY: none. The motion to suspend the rules was adopted by three-fourths of the Council and the statutory rule was declared suspended for consideration of said ordinance.
Said ordinance was then read by title and thereafter Council Member Stan Krause moved for final passage of the ordinance, which motion was seconded by Council Member Schrock. The Mayor stated the question was “Shall Ordinance No. 12-727-A be passed and adopted?” Upon roll call vote, the following Council Members voted AYE: Ryan, Schrock, Krause. The following voted NAY: none.
The passage and adoption of said ordinance having been concurred in by a majority of all members of the Council, the Mayor declared the ordinance adopted and the Mayor in the presence of the Council signed and approved the ordinance and the Clerk attested the passage and approval of the same and affixed his signature thereto and ordered the Ordinance to be published in pamphlet form as provided therein and to be posted in three public places in the City. A true, correct and complete copy of said ordinance is as follows:
ORDINANCE NO. 12-727-A
AN ORDINANCE CREATING STREET IMPROVEMENT DISTRICT NOS. 2013-1 TO 2013-6 INCLUSIVE IN THE CITY OF FRIEND, NEBRASKA, ORDERING THE CONSTRUCTION OF STREET IMPROVEMENTS THEREIN AND ORDERING THE PUBLICATION OF THE ORDINANCE IN PAMPHLET FORM.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF FRIEND, NEBRASKA, as follows:
Section 1. That there be and hereby are created in the City of Friend, Nebraska, street improvement districts to be known and designated as Street Improvement Districts Nos. 2013-1 to 2013-6 inclusive of the City of Friend, Nebraska.
Section 2. That the outer boundaries of Street Improvement District No. 2013-1 shall include, in addition to the street to be improved, all of the property abutting on such street to be improved and within which district, the following street shall be improved by removal and replacement of concrete base and panels as required, removal and replacement of asphalt overlay and all necessary appurtenances related thereto:
Sycamore Street, from 4th Street to 5th Street.
Section 3. That the outer boundaries of Street Improvement District No. 2013-2 shall include, in addition to the streets to be improved, all of the property abutting on such streets to be improved and within which district, the following streets shall be improved by removal and replacement of concrete base and panels as required, removal and replacement of asphalt overlay and all necessary appurtenances related thereto:
2nd Street, from Cherry Street to Sycamore Street, and
Spring Street, from 2nd Street to 1st Street,
which are found to be interconnecting streets.
Section 4. That the outer boundaries of Street Improvement District No. 2013-3 shall include, in addition to the streets to be improved, all of the property abutting on such streets to be improved and within which district, the following streets shall be improved by removal and replacement of concrete base and panels as required, removal and replacement of asphalt overlay and all necessary appurtenances related thereto:
4th Street, from Cedar Street to Cherry Street,
5th Street, from Cedar Street to Pine Street,
Pine Street, from 3rd Street to 5th Street,
Main Street, from 3rd Street to 6th Street,
Maple Street from 3rd Street to 5th Street and
Chestnut Street, from 3rd Street to 4th Street,
which are found to be interconnecting streets.
Section 5. That the outer boundaries of Street Improvement District No. 2013-4 shall include, in addition to the streets to be improved, all of the property abutting on such streets to be improved and within which district, the following streets shall be improved by removal and replacement of concrete base and panels as required, removal and replacement of asphalt overlay and all necessary appurtenances related thereto:
State Street, from 1st Street to 7th Street,
2nd Street, from State Street to Walnut Street, and
5th Street, from State Street to Walnut Street,
which are found to be interconnecting streets.
Section 6. That the outer boundaries of Street Improvement District No. 2013-5 shall include, in addition to the streets to be improved, all of the property abutting on such streets to be improved and within which district, the following streets shall be improved by removal and replacement of concrete base and panels as required, removal and replacement of asphalt overlay and all necessary appurtenances related thereto:
6th Street, from Maple Street to Cherry Street,
Chestnut Street, from 6th Street to 9th Street and
Cherry Street, from 6th Street to 9th Street,
which are found to be interconnecting streets.
Section 7. That the outer boundaries of Street Improvement District No. 2013-6 shall include, in addition to the streets to be improved, all of the property abutting on such streets to be improved and within which district, the following streets shall be improved by removal and replacement of concrete base and panels as required, removal and replacement of asphalt overlay and all necessary appurtenances related thereto:
Burley Park Road, from 10th Street to Chestnut Street and
10th Street, from Maple Street to Burley Park Road,
which are found to be interconnecting streets.
Section 8. Said streets shall be improved at public cost and said improvements shall be made in accordance with the plans, specifications and estimate prepared by the special engineers for the City and to be approved by the Mayor and Council.
Section 9. Notice of the creation of said Districts shall be published as provided by law in the Friend Sentinel, a legal newspaper published in and of general circulation in Friend, Nebraska.
Section 10. This ordinance shall be published in pamphlet form and take effect as provided by law.
