FRIEND CITY COUNCIL
MINUTES-SPECIAL MEETING
MAY 26, 2006
Mayor Horner called the special meeting of the City Council to order at 5:00 p.m. at the City Hall. Advanced notice of the meeting was given by posting in three prominent places in the City. All proceedings shown were taken while the meeting was open to the attendance of the public.
The Mayor, Roger Horner, presided and City Clerk, Debbie Gilmer, recorded the proceedings. The following Councilmembers were present: Harlan Schrock, Gary Tuttle and Dan Fricke. Dustin Weber was absent. A quorum being present and the meeting duly convened, the following proceedings were had and done.
Mayor Horner announced that the public hearing was now open at 5:01 p.m. to hear comments from the public relating to the City of Friend purchasing property legally described as Lot 138, Original Town, City of Friend, Saline County, Nebraska, except the east 17 ½ feet of the north 20 feet, and the adjoining party wall between Lots 137 and 138, and easement rights over Lots 136 and 137.
Review and discussion was had regarding a proposed Contract for Sale of Real Estate from Gail E. Gropp to the City of
Mayor Horner announced that if there were no objections or recommendations to be heard regarding the City of
Motion to approve the Contract for Sale of Real Estate was made by Councilman Tuttle, with the stipulation that Attorney Mullally verify the legal address reflected in this contract is correct. This motion was seconded by Councilman Fricke. On roll call voting aye, Schrock, Fricke, Tuttle. Nays none. Weber absent. Motion carried. (Copy of this contract is available at City Hall for public inspection during regular office hours.)
Discussion was had regarding proposed Resolution #06-06 authorizing the purchase of certain real property.
RESOLUTION NO. 06-06
A RESOLUTION OF THE CITY OF
WHEREAS, the City of Friend is in the process of assisting in the re-development of certain real estate within the 100 block of Maple Street in the City of Friend, and in this process is acquiring by gift or purchase real estate deemed necessary for re-development purposes; and,
WHEREAS, the City has negotiated with a landowner for the purchase of certain real estate deemed necessary for these purposes; and,
WHEREAS, a public hearing has been held to receive comments from the citizens of the City as to the necessity and need for such purchase; and,
WHEREAS, the City Council wishes, after public hearing, to authorize the purchase of the real estate upon the terms and conditions tentatively agreed to between the City and the landowner;
NOW, THEREFORE, BE IT RESOLVED:
1. The City Council hereby authorizes the purchase of the real estate legally described as follows:
Lot 138, Original Town, City of Friend, Saline County, Nebraska, except the east 17 ½ feet of the north 20 feet, and the adjoining party wall between Lots 137 and 138, and easement rights over Lots 136 and 137.
from the landowner, Gail Gropp, for a purchase price of $7,500, with 2005 property taxes paid by landowner, 2006 property taxes pro-rated to closing, and title insurance and closing fees, if necessary, to be divided equally between the landowner and the city. As per the tentative agreement with the landowner, the landowner shall cause the subject real estate to be cleared of all debris and rubble, and backfilled, at the landowner’s expense, and further allows the city an easement of ingress and easement over those portions of Lot 139 which are owned by the landowner for the purpose of assisting city contractors in the demolition of adjoining structures. The Mayor is authorized to execute all contracts and other documents deemed necessary to complete the purchase of this real estate in accordance with these terms.
Motion was made by Councilman Fricke, seconded by Councilman Schrock to adopt Resolution #06-06 authorizing the City of Friend to purchase Gropp property, Lot 138, Original Town, City of Friend, Saline County, Nebraska, except the east 17 ½ feet of the north 20 feet, and the adjoining party wall between Lots 137 and 138, and easement rights over Lots 136 and 137. On roll call voting aye, Tuttle, Fricke, Schrock. Nays none. Weber absent. Resolution #06-06 was passed and adopted May 26, 2006.
With no further business to come before the Council, motion to adjourn the meeting was made by Schrock, seconded by Fricke. On roll call voting aye, Tuttle, Fricke, Schrock. Nays none. Weber absent. Meeting adjourned at 5:30 p.m.
