FRIEND CITY COUNCIL

MINUTES-REGULAR MEETING

NOVEMBER 3, 2015

 

Mayor Vossler called the regular meeting of the City Council to order at 7:00 p.m. at the City Hall.  Advanced notice of the meeting was given by publication in The Sentinel, the appointed method for giving advanced notice.  All proceedings shown were taken while the meeting was open to the attendance of the public.

 

Mayor James Vossler presided and City Clerk Debbie Gilmer recorded the proceedings.  The following Councilmembers were present:  Phyllis Ryan, Harlan Schrock, Shane Stutzman, and Stan Krause. A quorum being present and the meeting duly convened, the following proceedings were had and done.

 

As required by the Nebraska Open Meetings Act, Mayor Vossler announced that a copy of the Nebraska Open Meetings Act has been posted on the south door of the City Hall meeting room for all in attendance to review. 

 

Mayor Vossler announced that public comments would be received at this time. No comments were offered.

 

Motioned by Schrock, seconded by Ryan, to approve the minutes of the October 6, 2015 regular meeting and the October 2015 Treasurer’s Report as presented and file same.  On roll call voting aye to approve the October 6, 2015 regular meeting minutes and the October 2015 Treasurer’s Report, Krause, Ryan, Stutzman, Schrock.  Nays none.  Motion carried.

 

Motion was made by Stutzman, seconded by Schrock to approve the WMH Financial Statements for September 2015.  On roll call voting aye, Ryan, Stutzman, Krause, Schrock.  Nays none.  Motion carried.

 

A motion was made by Krause, seconded by Stutzman, that payroll and claims be approved by the claims committee, and be allowed, and the Clerk instructed to issue warrants on the respective funds to pay same.  On roll call voting aye, Schrock, Ryan, Krause, Stutzman.  Nays none.  Motion carried.

On behalf of Farmer’s Union Coop Harlan Schrock thanked Utilities Superintendent, Patrick Gates for allowing Jr. Eklund to water down the road north of the railroad tracks during the time of harvest to help keep the dust under control.  Schrock also thanked the Friend Volunteer Fire Department for the use of a fire truck to do this.

 

Mayor Vossler introduced and read proposed Resolution No. 15-11.

 

 

 

RESOLUTION NO. 15-11

            A RESOLUTION OF THE CITY OF FRIEND, NEBRASKA CORRRECTING CERTIFICATION OF UNPAID ASSESSMENTS FOR STREET IMPROVEMENT PROJECT NO. 2012-1 TO THE COUNTY CLERK OF SALINE COUNTY.

 

            BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF FRIEND, NEBRASKA:

           

            THAT, pursuant to Neb. Rev. Stat. §17-514, the City Council hereby directs the City Clerk to amend the certification provided to the Saline County Treasurer regarding the portion of the special assessment now remaining unpaid and levied upon the property as described in Exhibit A, as specially benefitted by the improvements in Street Improvement Project No. 2012-1.  The City Clerk shall also submit the amended special assessment portion now remaining unpaid as to the property described in Exhibit A to the Saline County Clerk for entry upon the proper tax lists, with such special assessments to be thereafter due and payable to the Saline County Treasurer.  Attached hereto, marked as Exhibit A and made a part hereof by reference, is a list of the property against which the special assessment was made and the amended portion thereof that remain unpaid, as of September 2, 2015.

 

             In addition, the City Council hereby directs the City Clerk to refund said property owner identified in Exhibit A of all funds previously remitted to the City Clerk in lieu of the County Treasurer and not previously credited to said property owner’s special assessment totaling $152.13.

 

            Pursuant to Resolution No. 13-38 of the City of Friend, Nebraska such special assessment is to bear interest at the rate of five percent (5%) per annum until delinquent and is to be paid in equal annual installments over a fifteen (15) year period with the first installment being delinquent in fifty (50) days after the date of levy, being November 26, 2013.  

 

After discussion, it was decided to gather and forward information on aforementioned assessments to Marvin Kohout, Saline County Commissioner for his review and consideration.  Motion was then made by Krause, seconded by Ryan, to approve Resolution No. 15-11, correcting certification of unpaid assessment for Street Improvement Project No. 2012-1 to the County Clerk of Saline County.   On roll call voting aye, Schrock, Stutzman, Ryan, Krause.  Nays none.  Motion carried.

 

Utilities Superintendent, Patrick Gates gave his report.  Mr. Gates reported that he received correspondence from Nebraska Public Power District that included an Executable Wholesale Power Contract between NPPD and the City of Friend.  Mr. Gates recommended to the Mayor and Council that they approve renewing this by authorizing Mayor Vossler to sign the contract.  Motion was made by Krause, seconded by Schrock to approve renewing Executable Wholesale Power Contract between NPPD and the City of Friend by authorizing Mayor Vossler to sign such contract.  On roll call voting aye, Stutzman, Ryan, Schrock, Krause.  Nays none.  Motion carried.

 

Police Chief, Mark McFarland, gave his report.

 

Building Inspector, Mark Stutzman gave his report. Mr. Stutzman said the Planning Commission will be meeting to consider recent building permit application submitted by Friend Public School.

 

Motion was made by Schrock, seconded by Ryan, to accept Hazard Mitigation Plan as prepared by JEO Consulting Group, Inc. and approve its submission to Federal Emergency Management Agency (FEMA) and Nebraska Emergency Management Agency (NEMA).  On roll call voting aye, Krause, Stutzman, Schrock, Ryan.  Nays none.  Motion carried.

 

Mayor Vossler recommended Council consider approving Danielle Cox to be appointed to the Housing Authority to complete Wayne Umsted’s term of 2015 through 2019.  Motion was made by Stutzman, seconded by Krause, to accept Mayor Vossler’s recommended appointment of Danielle Cox to the Friend Housing Authority to complete Wayne Umsted’s term of 2015 through 2019.  On roll call voting aye, Ryan, Schrock, Krause, Stutzman.  Nays none.  Motion carried.

 

No further business to come before the City Council, motion was made by Schrock, seconded by Krause, to adjourn the meeting.  On roll call voting aye, Stutzman, Ryan, Krause, Schrock.  Nays, none.  Motion carried.  Meeting adjourned at 8:03 p.m.
